The territorial boundaries of the constituent states shall be as depicted in the map which forms part of this Agreement.1<\/p>\n<p>2. Areas subject to territorial adjustment which are legally part of the Greek Cypriot State upon entry into force of this Agreement, shall be administered during an interim period by the Turkish Cypriot State. Administration shall be transferred under the supervision of the United Nations to the Greek Cypriot State in six phases over a 42 month period, beginning 104 days after entry into force of this Agreement with the transfer of administration of largely uninhabited areas contiguous with the remainder of the Greek Cypriot State. United Nations supervision of activities related to territorial transfer shall be enhanced in the last months before handover of specified areas as outlined in the Agreement.<\/p>\n<p><strong>Mara\u015f Annan Plan\u0131na g\u00f6re K\u0131br\u0131s Rum olu\u015fturucu devletinin egemenli\u011fine ilk girecek toprak par\u00e7as\u0131d\u0131r. Plan oyland\u0131ktan 104 g\u00fcn sonra K\u0131br\u0131s Rum olu\u015fturucu devletinin himayesinde bulunacak. Bu noktada Mara\u015f\u2019\u0131n a\u00e7\u0131lmas\u0131 durumunda Annan Plan\u0131nda da K\u0131br\u0131s rum olu\u015fturucu devletinin himayesinde olacak olan bu topra\u011f\u0131n K\u0131br\u0131s Cumhuriyeti yarg\u0131 ve huku\u011funa tabi olmas\u0131 bir sak\u0131nca do\u011furmaz. \u00dcstelik bu K\u0131br\u0131s Cumhuriyeti\u2019nin olu\u015fturucu devlet seviyesine gelmesine, Federal devletin de egemenli\u011fini olu\u015fturucu devletlerden alacak olmas\u0131 ya da \u2018virgin birth\u2019 den gelmesine olanak sa\u011flayacak bir olas\u0131l\u0131k \u00e7\u0131kar\u0131r. (en az\u0131ndan s\u00f6ylemde)<\/strong><\/p>\n<p><strong>Annan Plan\u0131 Anayasa B\u00f6l\u00fcm 4: Federal H\u00fck\u00fcmet ve Olu\u015fturucu Devletler <\/strong><\/p>\n<p><strong>Madde 14 Federal h\u00fck\u00fcmetin yetki ve sorumluluklar\u0131<\/strong><\/p>\n<p><strong>F\u0131kra1, 5para: Do\u011fal kaynaklar ve su kaynaklar\u0131 federal h\u00fck\u00fcmete aittir. Buna ra\u011fmen 9 numaral\u0131 dipnot tar\u0131m ve bal\u0131k\u00e7\u0131l\u0131k faaliyetlerinin olu\u015fturucu devletlere ait oldu\u011funu belirler. 6nc\u0131 f\u0131kra: Meterology, havac\u0131l\u0131k, uluslararas\u0131 ula\u015f\u0131m, k\u0131ta sahal\u0131\u011f\u0131 ve karasular\u0131 Birle\u015fik K\u0131br\u0131s cumhuriyetine aittir. <\/strong><\/p>\n<p><strong>Bu noktada e\u011fer mara\u015f\u0131n karasular\u0131n\u0131n egemenli\u011fi konusu a\u00e7\u0131lacaksa o zaman \u00fcst egemenli\u011fi ta\u015f\u0131yan devlete bakmak gerekir. Federal devlet kuruluna kadar BM kontrol\u00fcnde olmas\u0131 \u00f6nerilebilir veya iki toplumun y\u00f6netece\u011fi ya da temsil edece\u011fi veya toplumliderlerinin kar\u015f\u0131l\u0131kl\u0131 olarak anla\u015faca\u011f\u0131 bir bi\u00e7imde egemenlik haklar\u0131 \u00fczerine \u00e7al\u0131\u015fma yapmak m\u00fcmk\u00fcn olabilir. \u00d6zellikle insan ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131na kar\u015f\u0131 m\u00fccadele konular\u0131nda uluslararas\u0131 sulardaki yetkiler \u00fczerine bakabiliriz. Ya da direk UN Deniz Huku\u011fu Konvensyionunu kabul ederek oradaki d\u00fczenlemeyi 1982 uluslararas\u0131 huku\u011fa g\u00f6re yapabilirik. (TR bu konvasiyonu ege sorunu nedeniyle imzalamaz ama tr bizi ilgilendirir mi bu a\u015famada bilmem.)<\/strong><\/p>\n<p><strong>Madde 15: Olu\u015fturucu devletlerin yetki ve sorumluluklar\u0131 <\/strong><\/p>\n<p><strong>F\u0131kra1: anayasa kapsam\u0131nda olu\u015fturuc devletler b\u00f6lgelerinde egemen bir bi\u00e7imde g\u00fcvenlik, hukuk ve nizam, y\u00f6netim adalet konular\u0131nda karar almaya yetkilidir. <\/strong><\/p>\n<p><strong>F\u0131kra 2: olu\u015fturucu devletler federal yasalara ayk\u0131r\u0131 su\u00e7lar\u0131, anayasa mahkemesine ba\u011fl\u0131 olacak olan su\u00e7lar olmad\u0131k\u00e7a, olu\u015fturucu devletin mahkemelerinde g\u00f6r\u00fc\u015f\u00fcr. <\/strong><\/p>\n<p><strong>F\u0131kra 3: olu\u015fturucu devletin polisi sadece kendi devletin g\u00f6rev yapar ve huku\u011fun uygulanmas\u0131 ve kamusal g\u00fcvenlik i\u00e7in olu\u015fturucu devletine hizmet verir, bu federal polis g\u00f6revlerini federal h\u00fck\u00fcmet ile olu\u015fturucu devletler aras\u0131ndaki i\u015fbirli\u011fi anla\u015fmas\u0131 belirler. <\/strong><\/p>\n<p><strong>Bu yasalar dahilinde K\u0131br\u0131s Cumhuriyeti egemenli\u011finde olu\u015fturucu devlet oldu\u011funda genel olarak oran\u0131n yasalar\u0131 ge\u00e7erli olabilir.
